Animal Attacks

Dogs, cats, cattle, horse, livestock and exotic animals often cause injury. Injuries caused by animals can be the result of a direct bite by the animal, or simply the animal having been in the wrong place (such as a dark rural highway) and causing an accident.

When an animal bites a person, the injuries can be severely painful and disfiguring. Unfortunately, it has been my experience that young children are the most common victims. The youngest children are usually quite scarred after such an attack. In animal attacks such as this you need not only compensation for the pain and suffering from the bite, as well as payment for the medical bills, but you also need compensation for the potential plastic surgery or emotional harm caused by scars.

One thing to watch out for in Texas is the persistent misunderstanding of the so called, "First Bite Rule". Many will tell you that if an animal has never bitten anyone before that the owner cannot be held responsible. This is not entirely true, and I encourage you to call to discuss the particular facts of your case.

In the case of animals causing accidents, you need not only a way to prove who owned the animal, but proof as to why and how the animal got to be in the wrong place. Cases like this require proving that the animal owner knew or should have known that the animal had escaped.

Even more difficult is whether the area where the animal escaped from is protected by a range law. Texas has certain areas where livestock owners are protected from liability for animals escaping their land.
