Types of Auto CollisionsIntersection CollisionsThe most contested automobile accidents involve intersections. In almost every case, both drivers claim to have had the right of way. Hopefully witnesses can establish what color traffic lights were, or other conditions that could have contributed to the accident. Without witnesses, these accidents become a he said/she said swearing match. Sometimes forensic evidence, city records of light sequences, or other information can help determine liability, but if you've been involved in an intersection collision, be prepared for a fight. Rear-end collisionsGrowing up, I always heard if you rear-ended another person, you were at fault. Surprisingly, insurance companies have managed to make the liability a fight at trial. They ignore following distance rules, proper lookout, evasive action, and other factors to argue the person who was rear-ended stopped suddenly or that some unknown person ahead (not involved in the accident) created an emergency, causing everyone to stop suddenly, and that liability falls on that unknown person. These arguments irritate me greatly; we all know if the person who rear–ended you had kept a proper following distance, there wouldn't have been an accident. Commercial VehiclesThere are a tremendous number of commercial vehicles on the road. Although companies are responsible to hire and train qualified drivers, they often don't verify if they have a driver's license at all. Another problem is these vehicles are often in poor states of repair. Combine the size and weight of the vehicles with the possibility of faulty mechanics and a negligent driver, and you have a recipe for terrible accidents with horrific damages. Governmental VehiclesLocal, state, and even Federal governmental vehicles are involved in accidents every day. There are special rules written to limit the liability of these drivers and make pursuing claims against these governmental agencies very difficult. If you have been in an accident with a governmental agency, you should hire an attorney immediately. There are far too many barriers to your recovery to go through this type of case alone. Pedestrians and BicyclesUnfortunately, pedestrians and bicyclist don't get fair treatment on the roadway. They are presumed to have the right of way, but when an impact between a large metal car and an unprotected individual on foot or a bicycle occurs, the car is the winner. The injuries from these accidents are often very terrible, and the insurance company will always try to argue the car had the right of way. On the Job Automobile InjuriesIf you were on the job when you were involved in a collision, don't think that workers' compensation is your only source of recovery. The person who caused the accident likely has insurance that can be forced to pay for the driver's negligence. The workers' compensation carrier will have a lien on your case, but it's better to deal with their lien than to not recover for your pain and suffering. PassengersPassengers are what I call "no negligence plaintiffs." A passenger can't do anything to avoid a collision; they can only sit and scream as they watch what's happening to them. Often, passengers can recover not only from the insurance on the car that hit them, but possibly on the car they were riding in, as well as their own.
